Under the American bankruptcy laws, you can “discharge,” or permanently rid yourself of certain kinds of debt, but you can only do so under Chapter 7. To be eligible to file for protection under Chapter 7, you must demonstrate to the bankruptcy court that you don’t have the income or resources to pay your creditors back over a 3-to-5-year period. To prove that, you must submit to what is known as a “means test.”
